The agreement
These terms are an agreement between [Company legal name] (“we”, “us”) and the business that creates a SupremeAir.ai account (“you”). By creating an account or using the service, you accept them. If you accept on behalf of a company, you confirm you are allowed to bind it.
Our Privacy Policy explains how we handle information and is part of these terms.
The service
SupremeAir.ai is software for running a service business: phone numbers and texting, online booking, scheduling, a technician app, estimates, invoices, a customer portal, automations and reports.
We improve the product often, so features may change. Features we describe as coming next or on the roadmap are plans, not promises, and you should not buy the service counting on them.
Your account and team
- Give accurate information when you sign up, and keep it current.
- Keep passwords private. You are responsible for what happens under your account, including what your team members do.
- You decide what each team member can see and do. Remove access promptly when someone leaves.
- Tell us right away if you think your account has been used without permission.
Plans, fees and billing
- Plans differ by how many companies you can run. The price of your plan is shown when you choose it or in your written order.
- Phone numbers, calls and text messages are billed at cost on top of your plan, as shown in your account.
- Fees are charged in advance for each billing period and are not refundable, except where the law requires a refund.
- Prices do not include taxes. You pay any taxes that apply, other than taxes on our income.
- We may change prices with at least 30 days’ notice. The new price starts at your next billing period.
- If a payment fails and is not fixed after we notify you, we may suspend the account until it is paid.
Your data
The information you and your team put into SupremeAir.ai, including your customers’ records, belongs to you. You give us permission to store, process and send it only as needed to provide the service, keep it secure, and as described in the Privacy Policy.
You are responsible for having the right to use the information you add, including your customers’ details, and for following privacy laws that apply to your business.
You can export your customers and reports at any time. After your account closes, we delete your data within 30 days, except records we must keep by law.
Calls, texts and recordings
Phone and texting are regulated, and you are the sender of the messages and calls your business makes through SupremeAir.ai. You agree to:
- Get the consent the law requires before texting or calling a customer, including under the Telephone Consumer Protection Act, and keep a record of it.
- Honor opt-outs. When someone replies STOP, do not text them again unless they opt back in.
- Give accurate information for texting registration with phone carriers, and keep it up to date.
- Follow carrier rules and the CTIA Messaging Principles, and not send spam, unlawful content or content carriers prohibit.
- Tell callers when calls are recorded where the law requires it. Some states require every person on a call to agree to recording.
Carriers decide whether messages are delivered, and they may filter or block messages. We may pause texting or calling on an account if a carrier, our phone provider or a complaint shows a likely breach of these rules. We will tell you and work with you to fix it.
Payments from your customers
Pay now buttons on your invoices open the payment processor you choose, such as Square, Stripe or SwipeSimple. Your agreement with that processor governs those payments. We do not process, hold or guarantee payments between you and your customers. Payments you record by hand, such as cash or checks, are records only.
Acceptable use
Do not use SupremeAir.ai to:
- Break the law, or help anyone else break it.
- Send spam, harass people, or impersonate another person or business.
- Upload malware, or try to get into accounts or data that are not yours.
- Disrupt the service, overload it, or get around its limits or security.
- Copy, resell or rebuild the service, or scrape it with automated tools.
Other companies' services
SupremeAir.ai connects to services run by other companies, such as phone carriers, Twilio, email delivery and payment processors. Their terms apply to your use of them, and we are not responsible for their services. We may change the providers we use to run SupremeAir.ai.
Availability and support
We work to keep SupremeAir.ai available and to fix problems quickly, but the service may sometimes be unavailable, for example for maintenance or because of outages at our providers or carriers. We will try to give notice of planned maintenance.
Ending the agreement
- You can close your account at any time. Export anything you want to keep first.
- We may suspend or close an account that breaks these terms, puts others at risk, or is not paid. When it is reasonable, we will tell you first and give you a chance to fix the problem.
- Sections about fees owed, your data, disclaimers, limits of liability, indemnity and governing law continue after the agreement ends.
Disclaimers
Except as these terms say otherwise, the service is provided “as is” and “as available”. To the extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. SupremeAir.ai does not give legal, tax or accounting advice. Sales tax rates and other settings you enter are your responsibility to check.
Limits on liability
To the extent the law allows, neither side is liable for indirect, special, incidental or consequential damages, or for lost profits, revenue or data, even if told they might happen.
To the extent the law allows, our total liability for any claim about the service is limited to the fees you paid us in the 12 months before the event that caused the claim.
Indemnity
You will defend us against, and pay costs arising from, claims by third parties caused by your data, your messages and calls, or your breach of these terms or the law, including claims about consent to calls or texts.
Governing law
The laws of the State of Texas govern these terms, without regard to conflict-of-law rules. Courts located in Texas have exclusive jurisdiction, and both sides agree to them.
Changes to these terms
We may update these terms. We will change the date at the top, and for significant changes we will tell account owners by email or in the app at least 30 days before they take effect. If you keep using the service after that, the new terms apply. If you do not agree, you can close your account.
